Background and Purpose
Vinyl Sulphone is a major chemical used in the production of reactive dyes and is widely used in textile industry for fabric dyeing. The Department of Chemicals and Petrochemicals (DCPC) in consultation with the Bureau of Indian Standards (BIS) has initially notified the Vinyl Sulfone (Quality Control) Order, 2024 on November 14, 2024. As per this order, Vinyl Sulphone products conform to Indian Standard IS 18340:2023 and bear BIS Standard Mark under a valid licence, as per Scheme-I of Schedule-II of Bureau of Indian Standards (Conformity Assessment) Regulations, 2018. The enforcement date was set for May 13, 2025.
Key Provisions of the Amendment
The Vinyl Sulfone (Quality Control) Amendment Order, 2025 introduces two major provisions. First, it gives the formal title of the amendment and establishes its commencement on the date of publication in the Official Gazette. Secondly, it revises the implementation date of the original 2024 order from May 13, 2025 to August 13, 2025, giving an extension of three months to stakeholders to align with the quality control requirements.
Implications for Industry Stakeholders
This extension provides additional time to the manufacturers, importers and distributors of vinyl Sulphone to confirm full compliance with the specified quality standards. It is important for these stakeholders to secure BIS certification and ensure that their product is compliant with IS 18340:2023. Failure to meet the compliance requirements after August, 2025 may result in regulatory action under the provisions of the Bureau Indian Standards (BIS) Act, 2016, which may include penalties or ban on the sale of non-compliant products in the Indian market.
Furthermore, the order also includes a major exemption: Vinyl Sulphone goods or articles especially for export are not subject to this Quality Control Order. This provision ensures that export-oriented units are not loaded with compliance requirements, which are not relevant to their international operations.
With the revised enforcement date, the Government has demonstrated a pragmatic approach by providing the industry more time to transition to compulsory BIS certification. Stakeholders are encouraged to use this extension period effectively to complete BIS registration processes, align production practices with the required standards, and avoid disruptions in supply chains post- August 2025.
