The operation of the business requires various licenses and Plant-based meat restaurants requires following of the Prevention of Food Adulteration Act, 1954, however in the later days a comprehensive regulation came into force namely the Food Safety and Standards Act, 2006 (FSS Act) was enacted, it regulates the Foods businesses through the Food Safety and Standards Authority of India (FSSAI) with the objective of bringing science-based standards for the food article and regulating their businesses of distribution, storage, manufacturing, sale, and import and ensuring the units are safe for human consumption.   • FSSAI License

FSSAI stands for the Food Safety and Standards Authority of India. Plant-based food businesses and restaurants require an FSSAI license for the operation of their businesses. The FSSAI licenses are of three types, which depend on the business's investment plan, the three Licenses are 

  1. FSSAI Registration
  2. FSSAI state license
  3. FSSAI central license 

The FSSAI can be made through an online or offline mechanism in the name of the business to be operated by the business owner. Individuals who operate their businesses without an FSSAI license face severe penalties. The terms of the license remain valid for 1 to 5 years, which varies from product to product.

  • Trade License 

Plant-based food restaurants require a trade license, which is the license to carry on business at the specified location relating to specified products authorized by the state authority. The license can be obtained from the municipality where the business is located. The trade license remains valid for a period of one year from the date of registration, which can be renewed through the payment of the annual license fee.

  • Fire NOC

The fire safety license is provided to business operations, restaurants, and other services through the Fire Authority. The fire safety license can be obtained through the building plans, architect certificate, and other safety rules and regulations 

  • Shops and Establishment Registration

The business of food-based meat restaurants and related businesses requires a commercial establishment license, which is provided through the respective state’s labor department. The application process on how to obtain the license for the Shops and Establishments must register.

  • Environmental Clearance

The business is operated through the process of registration as a shop and the establishment must be established and operated after obtaining environmental clearance from the State Pollution Control Board. The two licenses, "consent to establish" and "consent to operate," are mandatory for the operation of the same. The category for the business being operated varies from business to business and is decided by the Pollution Control Authority.

Food-based meat restaurants with an annual turnover of more than Rs 20 lakh are required to pay GST after obtaining the GSTIN.

  • Infrastructure Operation License

All other licenses required for the operation of the business, such as electricity authorization (even the use of a high-voltage generator requires authorization from an electrical inspector and generator registration), water supply licenses, waste management licenses, and so on, must be obtained by the owner. High-quantity use of flammable materials such as LPG, boilers, diesel, kerosene, etc. might require PESO certification upon exceeding the limited threshold. 

  • Employees Registration

As per the Labor Law, employers need to have registration of their employees from the various authorities prescribed in the Labor Law, such as registration of employees through the Employees Provident Fund registration, contract labor employee registration, employee state registration, etc. for more information regarding registration of your employees under the labor law.

  • Company Registration
