Most contemporary policies and regulations dealing with the end-of-life management of recyclable goods have been based on extended producer responsibility (hence referred to as "EPR"). Over the years, increased consumption of a variety of complex durable products has resulted in severe environmental issues. Policymakers have been concerned about how to properly handle the waste that has resulted. In the last decade, the government has made it mandatory for manufacturers of these commodities to be responsible for their end-of-life management. The majority of these policies are founded on the EPR principle, which holds producers accountable for environmental impacts throughout the product's life cycle. EPR is based on the polluter-pays concept (PPP), but it emphasizes the products' life-cycle impact. EPR is defined by the Organization for Economic Cooperation and Development (OECD) as "an environmental policy approach in which a producer's responsibility for a product is extended to the post-consumer stage of the product's life cycle, including its final disposal." EPR is not synonymous with corporate social responsibility ('CSR'), but rather with sustainable business practices.

The idea of PRO is acknowledged in India in two sectors: plastic waste management and e-waste management. The producer bears the primary responsibility for the collection of waste plastic electronic devices under the E-Waste (Management) Rules of 2016 and the Plastic Waste Management Rules of 2016. They must set up a mechanism for collecting waste generated as a result of their products.

PRO is defined as a professional organization authorized or financed collectively or individually by producers to collect and channel e-waste generated from the 'end-of-life' of their products in order to ensure environmentally sound handling of such e-waste. 4 A PRO/Agency is a professional organization that assists Producers/Brand Owners in meeting their EPR targets in the country by utilizing various processing technologies for plastic waste, including MLP or its End of Life applications, such as Waste to Energy, Waste to Fuel, Waste to Road, and Waste to Cement Kiln.

PRO (Producers Responsibility Organization) Authorization

The CPCB (Central Pollution Control Board) introduced the PRO (Producers Responsibilities Organization) regulation. As we all know, the growing use of durable products over time is the leading driver of environmental damage. As a result, officials should be concerned about waste management. The rules are linked and founded on the EPR principle (Extended Producer’s Responsibilities). As a result, companies will be held responsible for the environmental effects of their products throughout their whole existence. E-waste management is defined as the principle of PRO (Producers' Responsibilities Organization) in India.

Government Regulations Regarding Organizations' Producer Responsibilities (PRO)

Both the Plastic Waste Management Rules of 2016 and the E-Waste Management Rules of 2016 require producers to collect plastic electronic product waste. As a result, a system to collect waste generated as a result of the products is required.

Producers' Responsibility Organization's (PRO) capacity:

Both the agency and the producer offer information on their waste processing, storage capacity, waste material collection, and recyclers with whom they plan to do business. To accomplish the collection targets, a producer or agency must be skilled at channeling plastics and garbage.

Recycler's Responsibilities

  • Those interested in recycling or intending to recycle or process E-waste or plastic waste must register with the State Pollution Control Board and the Pollution Control Committee.
  • It should be the recycler's obligation to ensure that waste is appropriately managed.
  • The recycler should utilize pollution control devices to avoid polluting the environment.
  • Those that recycle or treat plastic waste shall submit an annual report to the local government, notifying the state pollution control board or pollution committee.
  • When it comes to application verification, the CPCB (Central Pollution Control Board) has sole jurisdiction to examine, inspect, verify, and decide on the application. The CPCB normally responds within 30 days.
  • The validity for registration renewal is 60 days before the expiration date. The registration under the E-waste management rules is valid for a period of three years.

How Does PRO Handle E-waste? (Pro E-waste)

The task of eliminating E-waste in India is urgent, and everyone should be aware of the problem and make a commitment to eliminate pollution caused by e-waste. The Indian government has taken steps to reduce e-waste output. As a result, PRO was introduced (Producers Responsibility Organization). Agreements have been struck between the PRO and the producers, or with a group of producers, outlining the PRO's role and responsibilities in the management of EPR. Process of PRO Authorization Registration

For the registration of PRO for both plastic and electronic waste management, an application form must be filed to the Central Pollution Control Board (CPCB).
