After the Orissa Legislative Assembly passed the Water (Prevention and Control of Pollution) Act, 1974, and the Air (Prevention and Control of Pollution) Act, 1981, the Odisha State Prevention and Control of Pollution Board was established in accordance with subsection (1) of Section- 4 of the Water (Prevention and Control of Pollution) Amendment Act, 1974, dated 16.07.1999, issued by the Forest and Environment Department, Government of Orissa, the Board was renamed as the State Pollution Control Board, Odisha. The Water and Air Acts precisely describe the Board's duties, which can be largely divided into three categories: enforcement, advisory, and monitoring, as well as research, public awareness-building, and facilitation.

What are the Objectives of the Odisha Pollution Control Board (OPCB) Registration?
The purpose of the Air (Prevention and Control of Pollution) Act of 1981 and the Water (Prevention and Control of Pollution) Act of 1974 is to enhance air quality, encourage the cleanliness of water bodies, and prevent pollution. The Board has the following responsibilities to carry out in order to achieve the goal-
- To create and implement a comprehensive plan for preventing, managing, and reducing air and water pollution.
- To offer advice to the state government on any issue relating to the reduction of air and water pollution.
- To gather and spread knowledge about water and air pollution, as well as ways to prevent, regulate, or lessen it.
- To assess plans, specifications, etc. For corrective steps and check sewage and trade effluent treatment plants for efficacy.
- Inspecting factories, production processes, control devices, and giving instructions on how to take action to prevent, control, or lessen air pollution
- To launch an industry, issue an environmental no objection certificate.
- To check places where air pollution is controlled in order to evaluate the quality of the air there and to take action to prevent, control, or lessen air pollution there.
- Regulate and control the sources that produce and cause noise.
- Keep an eye on whether the regulations for ground water, outdoor air, mooch quality, compost quality, and incineration are being complied with.
- Industrial facilities that are in default would be shut down, or their water or power may be cut off by orders of the board.
- To establish, alter, or annually revise regulations for sewage and commercial effluents, as well as for the release of any air pollutant into the atmosphere from any other source and the emission of pollutants from industrial facilities and vehicles.
- To develop the most effective, commercially viable sewage and trade effluent treatment system.
- To gather samples of trade effluents, sewage, and air pollution emissions, and to analyse those samples for a set of parameters.
- To work with the central pollution control board to organize mass education programs and the training of anyone involved or planning to be involved in programs linked to the prevention, control, or reduction of water and air pollution.
- Must carry out any additional duties that the state government or central pollution control board may specify.
Who needs an Odisha State Pollution Control Board (OSPCB) NOC?
In order to operate a manufacturing unit, clinic, hospital, hotel, or restaurant in the state of Odisha, an individual or project proponent must obtain a no objection certificate from the State Pollution Control Board and follow all applicable rules and regulations. Anyone wishing to run or build an industrial facility or any other project emitting a significant amount of industry effluent into the air, water or land in the State of Odisha must obtain permission from the Pollution Control Board.

How Are Industries Categorized Under The Odisha Pollution Control Board (OPCB) Certificate?
In order to make it simpler to work and share information online through the India E-track Web Portal, the Odisha Pollution Control Board has published a list of industrial units and processes divided into Red, Orange, Green, and White categories, all of which are fully consistent and similar to the serial numbers in the CPCB list. The newly amended list includes 43 types of units under the White category, 78 types under the Green category, 95 types under the Orange category, and 92 types under the Red category.
Industrial units listed under the Red, Orange, and Green categories must get permission to establish and permission to operate from the State Pollution Control Board of Odisha, whereas those listed under the White Category are exempt from these requirements. The OPCB classifies industries depending upon the Pollution Index of industries of each zone. The Pollution Index ranges from 0 to 100 with 100 being the highest level of pollutant being emitted by units. The categories of industries are classified as the following-
- Red Category: Pollution Index calculating to 60 or higher
- Orange Category: Pollution Index calculating from 41-59
- Green Category: Pollution Index calculating from 21-40
- White Category: Pollution Index calculating up to 20 or lower
The State Pollution Control Board of Odisha requires industrial units listed under the Red, Orange, and Green categories to get Consent to Establish and Consent to operate from the Board, whereas industrial units listed under the White Category are exempt from this need.
For Consent to Establish (CTE)
For the "Ease of Doing Business in the State" the Industries Department of the Government of Odisha has communicated the new "Business Reforms Action Plan" of the Department of Industrial Policy and Promotion (DIPP), Government of India. Under this plan, it is required that the validity period of Consent to Establish under the Water (Prevention & Control of Pollution) Act, 1974, and Air (Prevention & Control of Pollution) Act, 1981, be for a period of 5 years.
In accordance with Section 25 of the Water (Prevention & Control of Pollution) Act of 1974 and Section 21 of the Air (Prevention & Control of Pollution) Act of 1981, the Board authorises the establishment of mines and industries. If no significant physical progress has been made on the project during that time, the approval to establish order is valid for 5 years from the date it was issued.
For Consent to Operate (CTO)
Under the "Ease of Doing Business Program," the Government of India will grant consent to operate for highly polluting industries for a period of five (5) years, subject to reasonable compliance upon payment of applicable fees and subject to the requirement that the updated compliance status of the relevant industries will be uploaded.
- On payment of the necessary fees, the requisite consent to operate for enterprises under Red category shall be granted for a maximum duration of 5 years.
- On payment of the necessary fees, the needed period of time for granting consent to operate for projects under the Orange category is up to 10 years..
- The Board approved for exemption of Green category of industries from consent administration of the Board. This will be implemented after the approval of the Govt. in Forest & Environment Department. Hence, Consent to Operate may not be necessary for Green category industries once the Govt. approves the proposal of the Board. However, till Govt. approval is obtained for exemption of green category of industries from consent administration of the Board, Consent to Operate for Green Category of industries shall be granted for a maximum period of 5 years.
What is the Consent required under the Odisha Pollution Control Board (OPCB)?
- Consent to Establish
All new intending projects both Developmental and Industrial must obtain a "Consent to Establish" commonly known as NOC from State Pollution Control Board in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974, and the Air (Prevention and Control of Pollution) Act, 1981. The applicant can apply to the Board for Consent to Establish by providing the necessary fees, paperwork, and information through online services.
- Consent to Operate
According to the Water (Prevention and Control of Pollution) Act of 1974 and the Air (Prevention and Control of Pollution) Act of 1981, all operating units - including mines, industries, urban local governments, and health care units - as well as units that are just starting up must apply for permission to operate. You can apply to the Board for consent to operate by providing the necessary fees, documents, and information through online services. The Board grants the unit permission to operate after examining whether it complies with environmental rules. Periodically, the consent to operate must be renewed, and the renewal application must be submitted 120 days before the previous order expires.

- Copy of a mining plan that the Ministry of Coal or IBM has authorised, as appropriate. (only for mining project).

- Only the project located in the seriously contaminated area needs to provide a copy of the environmental clearance (if applicable).
Consent to Operate
- Application consent to operate in the specified format online.
- A current audited balance sheet and the appropriate fees required for getting permission to operate.
- Compliance with the requirements outlined in the CTE given by the Board for the first consent to operate case.
- When renewing Consent to Operate (CTO), the state of compliance with the requirements outlined in the prior consent to operate order, any terms of a bank guarantee granted by the Board, and any instructions issued for time-bound compliance.
- A copy of the State Environmental Impact Assessment Authority's (SEIAA) and the Ministry of Environment, Forestry, and Climate Change's (MOEF&CC) environmental clearance (if applicable).

How to Renew Consent under the Odisha Pollution Control Board (OPCB) Certificate?
Consent to Establish (CTE)
The consent to establish application must be submitted no later than six months after the date the consent to establish became valid. The Board will not accept any requests for revalidation of consent to establish that were made after the period of six months from the date of validity has passed. After six months after the validity date, the applicant must submit a new application. After the first consent to establish expires, the proponent may request auto-revalidation of the consent only once for a maximum of five years. After the first consent to establish expires, the proponent may request auto-revalidation of the consent only once for a maximum of 5 years.
Consent to Operate (CTO)
- Red category of project: 5 years
- Orange category: 10 years
