Any Private Limited Companies / Public Limited Companies / Proprietorship / Partnerships / One Person Company /LLP's, which is into the development of Export-oriented Computer Software/IT Enabled Services, can register itself as NON-STP unit under STPI to avail Softex certification. In order to become a NON-STP unit under STPI, the company has to get register itself with STPI on submission of application form along with the supporting documents, to the jurisdictional Director, STPI along with applicable processing fee of Rs.1000/- (one thousand only) + service tax in the form of demand draft in favor of the Director STPI.
Registered Non-STP units will be issued a Certificate of Registration (Annexure-II) with a validity of three years by the respective STPI center. Renewal of registration will have to be applied three months prior to the expiry of the registration.
Being registered with STPI, the Non-STP units will have to submit the quarterly report (Annexure-III) and annual reports (Annexure-IV) to respective STPI centers.
Once Non-STP units get registered with STPI they will be entitled to submission of Softex forms for certification as per prevailing guidelines of RBI. However, Non-STP units should also register each of their export contracts (Annexure V) prior to submission of Softex forms against that contract without paying any charges to STPI.
Service charges for Non-STP units (Annexure VI) will be determined on the basis of the value of the contracts registered.
STPI shall retain 20% of the service charges deposited in case Softex forms are required to be returned in the event of Non-Certification of submitted Softex forms (due to non-submission of required details).
Once the Non-STP units crosses the limit of a particular slab of the value of Softex certified in a financial year they will be required to deposit the charges for the next slab with due adjustment to the already paid amount.
Who is eligible to become a NON-STP unit under STPI and how?
Any business entity with principle objective of Export-oriented Computer Software/IT Enabled Services can register as NON-STP unit under STPI to avail the certification.

Is it mandatory to get registered as NON-STP unit under STPI?
As per the RBI Circular No. RBI/2013-14/14 on 1st July 2013 (Para B 15), RBI Circular No.80 on 15th February 2012 and RBI Circular No.43 on 13th September 2013, every company with principle business IT/ITES exports through data communication links needs to submit the Softex Form for certification.
For getting the Softex certification by STPI (which is the Designated Authority), the companies have to become STP members by registering under STP or as NON-STP unit with STPI. However, the companies registered under STP scheme will have several other benefits other than getting their Software Exports certified.

Non-STP registration is issued for a duration of 3 years. During the last three months prior to the expiry of LoP, a NON STP registered unit shall approach Director STPI for renewal of LoP. The process is free for renewal of LoP.
