This includes all establishments owned, controlled or managed by the Government, a trust, a corporation, a local authority and a single doctor. The major units to get clinical establishment online registration are as follows-

• Hospital
• Maternity Home
• Nursing Home
• Dispensary
• Clinic
• Sanatorium

Apart from the given establishments, the institutions providing services including the diagnosis, treatment, and care for injury, illness, deformity, abnormality, and pregnancy are also called clinical establishments. These clinical establishments need to get the Clinical Establishment Act Registration to legally operate in India. This provision for the registration of clinical establishments does not imply that the establishments are managed by the armed forces including the Army, the Navy and the Air Force.

The Ministry of Health and Family Welfare provides an online facility to register under the Clinical Establishments Act. There are two types of registration for medical facilities operating in India-

• Provisional Registration

No enquiry is to be done before the grant of the certificate of provisional registration, which is granted for one year at a time. The operator of such a clinical establishment needs to renew the registration certificate at least 30 days in advance before the date of expiry.

• Permanent registration

To get permanent registration, the clinical establishment needs to meet minimum standards as notified by the government. After a thorough inspection of these minimum standards, the clinical establishment is provided with the registration certificate which remains valid for a period of five years.

• The clinical establishment shall undertake to provide within the staff and facilities available such medical examination and treatment as may be required to stabilize the emergency medical condition of any individual who comes or is brought to such clinical establishment.
• Display the registration certificate at a prominent place on the premises of the clinical establishment.
• Ensure compliance with Standard Treatment Guidelines as may be determined and issued by the Central Government or State Government and updated from time to time.
• Maintain and provide electronic medical or health records of every patient, as may be determined and issued by the Central Government or State Government, as the case may be.
• Maintain and provide information and statistics in accordance with all other applicable laws that are in force and rules made thereunder.

• Failure to Register: Working without the certificate is considered a serious offence. A penalty of ₹25,000 may be imposed on facilities that fail to obtain registration before starting operations.
• Non-Compliance with Standards: Establishments that fail to meet the prescribed infrastructure or service standards face penalties and may have their registration revoked.
• Violation of Registration Conditions: Not adhering to the conditions attached to the registration certificate can result in suspension or cancellation of approval.
• Operational Restrictions: Authorities may impose restrictions or order the temporary closure of a facility if it continues to operate without fulfilling compliance requirements.
• Monetary Penalties:

1. Ten thousand rupees for the first contravention of the Act.
2. Fifty thousand rupees for the second offence.
3. Up to five lakh rupees for repeated violations.

If the authority is satisfied that an establishment has breached any provision, it can cancel the registration by issuing an order. Such an order becomes effective immediately if no appeal is filed within the prescribed time.

These are the functions of the National Council for Clinical Establishments under the Ministry of Health & Family Welfare:

• Establish and release a comprehensive national database of clinical establishments within two years of the Act's implementation.
• Develop minimum standards for establishments and conduct periodic reviews.
• Collect statistics regarding clinical establishments across India.
• Classify establishments into various categories based on services.
• Determine the first set of standards for proper healthcare delivery within 2 years of formation.

Small clinics may have lower charges compared to large multi-speciality hospitals. The payment is made during submission of the Clinical Establishment Registration Form through the state portal. Validity of Clinical Establishment Certificate

The Clinical Establishment Certificate is generally valid for 3 to 5 years. It depends on the rules of the respective state.
